Defendant Michael Albrecht appeals his 1985 robbery conviction from Custer County following revocation of his suspended sentence in 1988 for parole violations. The defendant, who was returned to prison after the suspended sentence was revoked, filed a petition for post-conviction relief. Because a notice of appeal had been timely filed but never docketed in 1985, the Attorney Generals answer to defendants petition noted that defendant did not receive proper representation on appeal. Counsel for defendant was then appointed and a transcript of the 1985 lower court proceedings prepared. Upon review of the 1985 proceedings we affirm the trial courts judgment
