The opinion of the court was delivered by This is a direct appeal by the defendant, Gary K. Alderdice, from his conviction of aggravated robbery in violation of K.S.A. 21-3427, a class B felony. He was sentenced to be imprisoned for not less than ten years nor more than life, pursuant to K.S.A. 21-4501 (b). He contends that the trial court erred in receiving into evidence the preliminary hearing transcript of the testimony of John Purdy; in its rulings on the admissibility of exhibits; in its jury instructions; and in denying probation without conducting a further hearing.
